This online store allows customers to purchase items from Birdie NZ Limited.  By accessing or using the online store, you agree that you have read, understood, and agree to be bound by these Terms.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before committing to buy it; (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

We make every effort to display as accurately as possible the colours, features, specifications, and details of the available products on the online store.  However, we do not guarantee that the colours, features, specifications, and details of the available products will be accurate, complete, reliable, current or free from errors.  Your electronic display may not accurately reflect the actual colours or physical details of the products.  

All products are subject to availability, and we cannot guarantee that products will be in stock.  Any orders that cannot be fulfilled due to stock availability or any other reason will be refunded in full without compensation. 

We reserve the right to discontinue products at any time for any reason.  Prices are subject to change at any time.

We accept credit card payments and bank transfers.  You agree to provide current, complete and accurate purchase information and account information for all purchases made via the online store.  You further agree to promptly update your account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.  

All prices are in New Zealand dollars and include GST.  

You agree to pay all charges for your products, including any applicable shipping fees, and you authorise us to charge your chosen payment provider for any such amounts upon placing your order.  We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.  You are entitled to reject a pricing correction, and in this case, a full refund will be made without compensation. 

We reserve the right to refuse/void any order placed through the online store.  Any void orders will be refunded in full without compensation/or reason.  

We may, in our sole discretion, limit quantities purchased per person, per household or per order.

You agree to indemnify and hold Birdie NZ Limited harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the online store or any of the services /products offered on the online store.

To the maximum extent permitted by applicable law, in no event shall Birdie NZ Limited, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the online store.

To the maximum extent permitted by applicable law, Birdie NZ Limited assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our online store; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

We reserve the right to modify these terms from time to time at our sole discretion.  All current terms are available for viewing during the purchase process.  If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the online store.

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices, please notify us at any time. 

These Terms, the rights and remedies provided hereunder, and any claims and disputes related hereto and/or to the online store, shall be governed by, construed under and enforced in all respects solely and exclusively following the internal substantive laws of New Zealand, without respect to its conflict of laws principles. 

To expedite resolution and control the cost of any dispute, controversy, or claim related to these terms and conditions or the use of our online store, brought by either you or us, the parties agree to first attempt to negotiate any dispute informally for at least 30 days before initiating arbitration.  Such informal negotiations commence upon written notice from one party to the other party.  

You hereby consent to any arbitrations being decided exclusively by a court of competent jurisdiction located in Wellington, New Zealand.
